What is a Texas DWI?
At the bare minimum, a first-time DWI offense is a Class B misdemeanor. Under Chapter 49 of the Texas Penal Code, it is illegal to operate a vehicle with a blood alcohol content (BAC) of .08 percent or higher. For drivers of commercial vehicles, the legal limit is lowered to .04 percent. An underage driver (defined by Texas law as anyone under 21) can be charged with Driving with Intoxicated or Driving under the Influence for any amount of detectable alcohol.
Citizens may be charged with DWI even if they’re BAC is alleged to be under the legal limit, as intoxication may also be alleged based on an operator of a vehicle having lost “the normal use” of their mental and/or physical faculties to safely operate a vehicle due to some form of intoxicant. It need not even be alcohol, as people operating a vehicle may accused of being “intoxicated” due to marijuana, prescription drugs, controlled substances, and even over the counter medications!

DWI Penalties in Texas

Penalties for a first-time DWI offense may include:
- Between 3 and 180 days in jail+
- Up to $2,000 in fines

High (greater than 0.15) BAC allegations or previous DWI convictions can raise the penalty to a Class A Misdemeanor, and up to a year in the county jail, and double the fines. DWI allegations when one has two more prior DWI convictions, or if it is alleged that there was a child in the car, can lead to felony charges. If an injury or death is alleged as the result of driving while intoxicated, one could be charged with the serious felonies of Intoxication Assault or Intoxication Manslaughter.
